Your privacy is important to us. It is Gosu Inc's policy to respect your privacy regarding any information we may collect from you via our app, GosuNow, and its associated services.
1. Terms
By accessing our app, GosuNow, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing GosuNow. The materials contained in GosuNow are protected by applicable copyright and trademark law.
2. Use License
- Permission is granted to temporarily download one copy of GosuNow per device for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
- modify or copy the materials;
- use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
- attempt to decompile or reverse engineer any software contained in GosuNow;
- remove any copyright or other proprietary notations from the materials; or
- transfer the materials to another person or "mirror" the materials on any other server.
- This license shall automatically terminate if you violate any of these restrictions and may be terminated by Gosu Inc at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
3. Disclaimer
- The materials within GosuNow are provided on an 'as is' basis. Gosu Inc makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
- Further, Gosu Inc does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to GosuNow.
4. Limitations
In no event shall Gosu Inc or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use GosuNow, even if Gosu Inc or a Gosu Inc authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
5. Accuracy of materials
The materials appearing in GosuNow could include technical, typographical, or photographic errors. Gosu Inc does not warrant that any of the materials on GosuNow are accurate, complete or current. Gosu Inc may make changes to the materials contained in GosuNow at any time without notice. However, Gosu Inc does not make any commitment to update the materials.

Gosu Inc has not reviewed all of the sites linked to its app and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Gosu Inc of the site. Use of any such linked website is at the user's own risk.
7. Modifications
Gosu Inc may revise these terms of service for its app at any time without notice. By using GosuNow you are agreeing to be bound by the then current version of these terms of service.
8. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of Delaware and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
Coaching Agreement
This agreement is entered into by and between GosuNow, and individual (You) whereby Coach agrees to provide Coaching Services for Client focusing on the following topics/results/outcomes/goals.
Description of Coaching: Coaching is a partnership (defined as an alliance, not a legal business partnership) between the Coach and the client in a thought-provoking and creative process that inspires the client to maximize personal and professional potential. It is designed to facilitate the creation/development of personal, professional, or business goals and to develop and carry out a strategy/plan for achieving those goals.
A. The client is solely responsible for creating and implementing his/her physical, mental and emotional well-being, decisions, choices, actions, and results arising out of or resulting from the coaching relationship and his/her coaching calls and interactions with the Coach. As such, the client agrees that the Coach is not and will not be liable or responsible for any actions or inaction, or any direct or indirect result of any services provided by the Coach. Client understands coaching is not therapy and does not substitute for treatment if needed, and does not prevent, cure, or treat any mental disorder or medical disease.
C. Client further acknowledges that he/she may terminate or discontinue the coaching relationship at any time.
D. Client acknowledges that coaching is a comprehensive process that may involve different areas of his or her life, including work, finances, health, relationships, education, and recreation. The client agrees that deciding how to handle these issues, incorporate coaching principles into those areas, and implementing choices is exclusively the client’s responsibility.
E. Client acknowledges that coaching does not involve the diagnosis or treatment of mental disorders as defined by the American Psychiatric Association and that coaching is not to be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals and that it is the client’s exclusive responsibility to seek such independent professional guidance as needed. If a client is currently under the care of a mental health professional, it is recommended that the client promptly inform the mental health care provider of the nature and extent of the coaching relationship agreed upon by the Client and the Coach.
F. The client understands that to enhance the coaching relationship, the client agrees to communicate honestly, be open to feedback and assistance, and to create the time and energy to participate fully in the class.
G. The parties agree to engage in a scheduled class or private class through GosuNow App. The coach will be available to the client by in-app chat in between scheduled classes as defined by the Coach.
Coaching Services
You acknowledge and agree that: you shall be solely responsible for determining the most effective and efficient manner to perform each instance of Coaching Services; and except for the platform, you shall provide all necessary equipment, tools and other materials, at your own expense, essential for you to perform Coaching Services.
Your Relationship with Company
You acknowledge and agree that the Company’s provision to you of the platform creates a direct business relationship between the Company and you. The Company does not, and shall not be deemed to, direct or control you generally or in your performance under this agreement and your provision of Coaching Services. You retain the sole right to determine when, where, and for how long you will utilize the platform and provide the Coaching Services. You keep the option, via the platform, to accept or to decline a User’s request for Coaching Services. You acknowledge and agree that you have complete discretion to provide services or otherwise engage in other business or employment activities, including the provision of services similar to those rendered hereunder that do not otherwise violate this agreement. The Company retains the right to deactivate or otherwise restrict you from accessing or using the platform or providing the Coaching Services at any time in its sole discretion.
Background Check
You at this moment agree that GosuNow may perform a standard background check at Company’s sole discretion and expense.
Coach Age
You are at least 18 years old, and all profile information you provide in setting up your GosuNow is true and accurate and that you will update it to reflect any subsequent changes. If you are under the age of 18, you may not use the platform. Failure to do so will prevent you from offering Coaching Services on the Platform.
Changes to Fee
Company reserves the right to change the Fee Calculation at any time in Company’s discretion and upon the provision of notice to you. Continued use of the Coaching Services after any such change in the Fee Calculation shall constitute your consent to such change.
Service Fee
You agree to pay Company a service fee on a per Coaching Services transaction basis calculated as a percentage of the Fee determined by the Fee Calculation, as provided to you via email. (“Service Fee”). Company reserves the right to change the Service Fee at any time in Company’s discretion, and Company will provide you with notice in the event of such change.
Payments
Payments made via Paypal or such other payment processor as Company may designate upon the provision of notice to you. You may withdraw any Fees above the transaction minimum ($30) at any time using your Paypal account or another such payment processor, as made available by GosuNow. All payments may be made in the original currencies in which the Coaching Services were purchased. Any fees charged by Paypal or any other such payment processor in connection with your receipt and withdrawal of funds shall be your sole responsibility.
Cancellation Policy
If a coach schedules a class and, for any reason, needs to cancel the class, the coach must cancel at least 5 hours before the class start time. If the coach fails to cancel the class at least 5 hours before the start time, and this is their first or second violation, they will receive a written warning. On the third violation of this cancellation policy, GosuNow reserves the right to remove the coach from their platform.
No Poaching
You further agree that you shall not provide Coaching Services outside of the platform to any user that you were introduced to, or whose identity you obtained, through the platform for two (2) years from the date you last provided such services to any user under this agreement.
Non-Disparagement
You agree that you will not make any defamatory statements about GosuNow on social media or other related, public platforms, or share abusive comments about Gamer Sensei publically.
Chat Room Agreement
By entering and participating in the GosuNow chat rooms developed and managed by Gosu, Inc ("Organization"), the member acknowledges the binding nature of this agreement and hereby agrees to the following terms of use:
Chat Room Terms and Conditions
The Organization shall not be liable for any form of content that any member of the Chat Rooms posts or shares to the chat rooms. The member may access the materials contained in the Chat Rooms at their own risk.
Should the member have any opinions or suggestions that they intend to express in the Chat Room, the member understands that the Organization does not support or provide credence for reliance on such statements made by any member of the Chat Rooms.
The member shall assume liability for all of their opinions, claims, and statements made in the Chat Rooms. The member acknowledges the risk of their actions and shall accept accountability for any complaints or reports filed by other members against them.
The member hereby authorizes other members of the Chat Rooms an irrevocable and free license to publish, disseminate, or download any and all of the content posted by the member in the Chat Room.
Should the Organization receive any complaints or reports regarding communications in the Chat Room that are contrary to the terms and conditions of this agreement, the Organization may, at its own discretion, conduct further investigations.
The Organization reserves the right to terminate any items from the Chat Room for a justifiable reason and at its sole discretion. This constitutes any form of content deemed disruptive, offensive, threatening, or illegal in nature.
The Organization has the full authority to terminate or disqualify members from any participation or access to the Chat Rooms for reasonable cause, including any violation of this agreement and complaints from members of the Chat Rooms.
The Organization reserves the full right to terminate the Chat Room at any given time, with or without reason. The member shall hold the Organization harmless against any disputes, claims, actions, and liabilities that may arise from the said termination.
under no circumstance shall the Organization be liable for any loss, injury, or death resulting from engaging or participating in the Chat Room. However, the Organization shall willingly cooperate with the authorities in conducting the appropriate investigation.
